As the world is opening its eyes to the abuse which happens behind closed doors, the law is following quickly behind. More and more, we are seeing the Court recognise all aspects of abuse which has seen the rise of a new term, ‘controlling and coercive behaviour’.
In January 2021, a ground-breaking case, brought control and coercive behaviour to the forefront of the Court’s mind and pushed them to change their understanding of abuse and attitude toward victims.
Abuse is not just physical and in our experience, can often be a pattern of behaviour including acts of assault, threats, humiliation and intimidation or other abuse that is used to harm, punish, or frighten a victim.
This controlling behaviour is designed to make a person dependent on the perpetrator of violence by isolating them from support, exploiting them, depriving them of independence and regulating their everyday behaviour.
This is now termed as controlling and coercive behaviour.
Victims of domestic violence often find it hard to see that they are suffering at the hands of an abuser, and sometimes feel as though no one will listen to them, especially if they do not show physical signs of abuse. We want to reassure you that the Courts will recognise controlling and coercive behaviour as a form of domestic abuse in the UK and it will be treated on the same level as physical abuse.
